Apr 4, 2012 - IL v. Caballes says they can use the dogs if it doesn't prolong the stop. He can't make you wait for the K-9.
JediRebelKid Says:
Apr 4, 2012 - Yeah, I know. I was just pointing out that just because you ask "Am I being detained or am I free to go" doesn't mean that the cops wont call the dogs, even without probable cause they can call them in.If its going to be a minute before the dogs arrive the cops can easily make up a lie and say that they smell marijuana. That gives them probable cause to briefly detain you until their investigation is complete. Basically, the cops can do whatever they want to do.
JediRebelKid Says:
Apr 4, 2012 - Yep. We live in a Police State.

All the cop has to say is, "im still conducting a investigation" and he is free and clear. this so called lawyer is all about selling his dvd.

Apr 23, 2012 - This may be a stupid question... but does this apply under Canadian law as well?
dogeatgiraffandvv Says:
Apr 24, 2012 - dangerous way to think...
Daniel Leahy Says:
Apr 24, 2012 - This would not happen in Wisconsin. Under Wisconsin Department of Justice standards the police are required to tell you the reason for the traffic stop is over and you are free to go before asking for consent to search a vehicle.Plus, if they choose to call for a police dog, they're not allowed to make you wait until the dog gets there longer than a normal traffic stop would last.

Apr 27, 2012 - and he still ends up payin the Man at the end of the video.. that's all they're after. OUR WALLETS
indigothecat Says:
May 3, 2012 - It could have been far worse if he acted out his frustrations. It sucks, but being civil, polite, and forcing the police to consider your legal rights is the best way to defend yourself from even more citations for the same stop and from police brutality. Also, if you don't admit to any crimes and you feel the citation is incorrect, you can challenge it in court, and provided you didn't admit to the crime, you may have a chance to have the citation dropped. The keyword is "chance," though.
supramayan Says:
May 3, 2012 - so just be polite while bending over. that way you don't get hurt any worse. cooperate. hmmmmm.. sounds familiar.. something like what would be applied in either a rape or robbery situation.
indigothecat Says:
May 3, 2012 - I know it really sucks... and I would have been just as pissed as him. :(
supramayan Says:
May 3, 2012 - least i'm not the only one who realizes this
