What Are Rights?

Students, get a full week of this at a summer seminar: lrnlbty.co Individuals have rights. But are they natural? And how do they compare and contrast with legal or constitutional rights? Are legal or constitutional rights similar to those inalienable rights mentioned in the Declaration of Independence? Professor Aeon Skoble distinguishes such constitutional rights, such as the right to vote, from the rights protected by governments and constitutions—natural rights not actually granted by governments themselves. He concludes that legal systems should create rights that are compatible with natural rights.

Open Carry is legal in Philadelphia with a valid license to carry firearms; openly carrying on foot is legal without a license everywhere else in Pennsylvania. "On a Sunday afternoon, a Pennsylvania resident was walking up Frankford Avenue in Philadelphia, bound for an auto parts store, and happened to be legally openly carrying a Glock pistol on his hip, under PA state law. A passing Philadelphia Police officer saw his walking up the road, pulled over his squad car in the middle of the busy street, and drew his weapon on the man, threatening to kill him multiple times if he moved. The man was arrested, stripped of his possessions, and thrown in the paddywagon, while several Philadelphia Police officers made multiple phones calls to try and find out what law they think he broke. In the end, they discovered that he was in violation of no laws, and was sent on his way, after having been illegally arrested for 45 minutes and his 4th Amendment rights blatantly violated." Guns, Laws, and Panics: How Fear, Not Fact, Informs the Gun Rights Debate

California has among the strictest gun laws in the country, and couple of local politicians are seizing the opportunity created by the Arizona shooting to make them even stricter. While most states operate under a "shall-issue" concealed carry weapons (CCW) permitting regime, meaning that anyone who passes a basic background check can get a CCW, California uses the "may-issue" rule, which means the decision is left to the sole discretion of the county sheriff. The result? Approximately 0.1% of California citizens have CCWs, which is almost 20 times lower than in the average shall-issue state. This restrictive climate has led to the emergence of a burgeoning "Open Carry" movement, wherein citizens carry holstered, unloaded weapons in plain sight. California Assemblyman Anthony Portantino calls the open carry exemption in the law a "loophole," which he intends to close with Assembly Bill 144 (AB 144). Portantino's fellow Assembly member Lori Saldana tried to ban open carry in 2010, but the bill failed in the assembly. But this time, AB 144 has gained helpful momentum from an unexpected source: Jared Loughner. "Since the events in Arizona, gun issues have taken on a greater national debate and a greater significance," says Portantino. Earlier this year, AB 144 passed the Assembly and now will head to the state Senate in late August 2011 and then on to Governor Jerry Brown's desk. Studies show that this idea is gaining momentum around Europe, but studies also show that discrimination is still widespread in the work place. Euronews spoke to a man who, between 1993 and 2004, was a victim of discrimination in France. Because of what happened he wants to remain anonymous; we'll call him Marc. He said: "I was met with great hostility because of my homosexuality. You would come back from lunch and on your desktop would be a note reading 'Death to the faggot' or 'Dirty faggot'. You're working and you receive anonymous phone calls - death threats. And you're put down all the time, given the worst jobs and you can, as happened with me, end up for months and months in a room, completely isolated, without being given any work, without seeing anyone." In 2000, two EU directives were introduced, they provided a legal framework to fight against discrimination at work. These guidelines recognised Marc's sexuality and gave him the legal rights to protect himself. "Europe showed that homosexuals had the right to respect too.
