Michael Hayden: "probable cause" is not in the 4th Amendment
In this disturbing exchange we see former head of the NSA, General Michael Hayden, argue with reporter Jonathan Landay that the words "probable cause" are not found in the Fourth Amendment. I don't want to spoil the suprise for you, but "probable cause" is the measure for issuing a warrant in the Fourth Amendment. Of course, I would find this exceptionally humorous had not Bush recently appointed this man to be the new head of the CIA.

If you are a lawyer, you will most likely disagree with this video. The origins of the term "probable cause" go back further than the 4th Amendment, but the term "cause", in my opinion, SHOULD be apparent to anyone who understands what the word "cause" means - something which is the ORIGIN of some SPECIFIC event. The term "probable cause", I believe, has been transformed over the years. Notable court cases that have done this have been: Illinois v. Gates (1983), Terry v. Ohio (1968), United States v. Matlock, 415 US 164 (1974), Georgia v. Randolph, 126 S. Ct. 1515 (2006), and New Jersey v. TLO (1985). NOW, the term has come to mean a POTENTIAL cause of a POSSIBLE crime rather than the plain English definition of a PROBABLE cause of a specific EFFECT (a crime that has been committed). This bastardization of the language has been the rallying cry for many people, mostly in government, to arrest and search people based on "reasonable suspicion" that a crime MAY have taken place, is taking place, or may take place in the future. R/C Jet Crash GoPro RF probable cause
1st Day at Jet Action Monarto (AMA) Adelaide South Australia May 2011. It went off the air for some unknown reason. Batteries, fuel, etc all checked and good! The only thing different to this flight to the last few that day was I added the GoPro to the inner wing. RF?? But after some analysis on the Transmitter (Futuba 14mz) and the ECU it was clear that the plane went into failsafe as it had lost connection. Some Google searching also confirmed that thgere have been reports of RF interference with GoPro's so we are pretty convinced that's what is was. In addidtion to this you will note the plane goes into fail safe just after achieving level flight where the GoPro was right in the line of sight of my transmitter and the receiver. Check out www.rcgroups.com re RF problems. The GoPro's however are pretty tough - not a scratch after a 200km/h++ crash. Its a pitty because they take such great video.

Taken from the Fourth Amendment of the Constitution, probable cause, simply put, means the reasonable belief that a person has committed a crime. It is the standard by which an officer or law enforcement agent has the grounds to make an arrest, to conducts a valid search of a person or property, or to obtain an arrest warrant. Probable cause is what is supposed to protect people from unreasonable searched and seizures. Additionally probable cause is the standard used by a grand jury to determine if they believe a crime has been committed or not.

This officer lied about smelling alcohol and seeing red and watery eyes. He did this to compel a breathalyzer and refused to allow me to take a blood test as required by law.

Texas Senate TSA Hearings and Public Testimony 6-27-11
Today, we drove to Austin, Texas to hopefully influence legislation in our state that could set a precedent for change in the current policy of the way the TSA screens travelers. David Simpson, the author of the original legislation, was hoping for Probable Cause, which specifies that the fourth amendment to both the US Constitution and also the Texas Constitution, which prohibits unreasonable searches and implies that searches made without "probable cause" are INHERENTLY UNREASONABLE. PROBABLE CAUSE IS THE THE CONSTITUTIONALLY BASED STANDARD. The federal government has beared down on our state legislators and attorney general, even threatening to shut down our airports if the original legislation was to pass, stating that the reason they would do this is because they could not "effectively screen passengers". Now, some of our elected officials wish to change the language in the original bill to "Reasonable Suspicion". This term IS NOT found in either to the US Constitution or the Texas Constitution. The phrase was first applied by the Us Supreme Court in 1968 in the case of Terry v. Ohio. Until then, lower standard had no place whatsoever in the Court's Fourth Amendment jurisprudence. Suspicionless Border Patrol Trunk Searches
The two encounters included in this video took place in February 2010 and depict Border Patrol agents searching vehicle trunks absent any reasonable suspicion or probable cause. While folks may argue that the drivers gave 'consent' to the searches, the reality is that in many cases if you don't give 'consent' for an agent to rifle through your personal effects, you are directed over to secondary inspection where the harassment continues at an elevated level until you either relent to a search, they fabricate 'probable cause' or they get tired of playing with you. The particular checkpoint depicted in this video is located along SR86 in Southern Arizona near mile marker 146 & only 4 to 5 miles from Three Points, AZ. SR86 is an East-West highway that never intersects the border at any point and is not a nexus point for border traffic.

While driving Eastbound on SR86 in Southern Arizona on September 4, 2008, I was seized by three armed federal Homeland Security agents at an internal suspicionless checkpoint located over 40 miles North of the Southern border. Agent LeBlanc, the K9 agent, ran his drug sniffing dog around and on my vehicle while searching for drugs and people absent suspicion. His supervisor, Agent DeLeon? just stood there allowing his subordinate to not only utilize a drug sniffing dog on my vehicle at what is supposed to be an immigration checkpoint but also allowed LeBlanc's drug dog to board my vehicle and sniff around the truck bed absent probable cause or consent. Such an action turned a cursory dog sniff into a full-fledge drug search absent reasonable suspicion or probable cause. Additionally, with no visible name tag, the field supervisor was out of uniform and refused to spell his name which wouldn't have been necessary if his name tag had been visible.

Never mind the fact that not only is this highly unconstitutional and unnecessary . But we are to just accept, that the people kicking down your doors are officers of the law without checking their credentials before they actually kick down your door. for all you know you could be getting robbed, you could be in danger, but no it's just the law kicking your door in if you, make ANY NOISE that they think is "suspicious" without answering the door. There is one loop-hole to this though, and it starts with you taking action. But the real loop hole to this new law is that you have to "INVOKE" your right to say "I do not want you in my house, "AFTER" you answer the door! THEN they can not enter. But everything before then is fair game to them ala: A: you don't answer the door withing a minutes time, your door get's kicked down costing you money, and your freedom to live in your home without warrant less searches or probable cause. B: if you don't answer the door or "CALL OUT" to them saying "I WILL BE RIGHT THERE" you must answer the door, or any NOISE considered "SUSPICIOUS" will now be enough PROBABLE CAUSE for them to kick down your door.
