The Great Gibson Guitar Raid: Months Later, Still No Charges Filed
"They...come in with weapons, they seized a half-million dollars worth of property, they shut our factory down, and they have not charged us with anything," says Gibson Guitars CEO Henry Juszkiewicz, referring to the August 2011 raid on his Nashville and Memphis factories by agents from the Departments of Homeland Security and Fish & Wildlife. The feds raided Gibson for using an inappropriate tariff code on wood from India, which is a violation of the anti-trafficking statute known as The Lacey Act. At issue is not whether the wood in question was endangered, but whether the wood was the correct level of thickness and finish before being exported from India. "India is wanting to ensure that raw wood is not exported without some labor content from India," says Juskiewicz. Andrea Johnson of the Environmental Investigation Agency (EIA) counters that "it's not up to Gibson to decide which laws...they want to respect." She points out that Gibson had previously been raided under The Lacey Act for imports from Madagascar. This much is clear: The government has yet to file any charges or allow Gibson a day in court to makes its case, much less retrieve its materials. "This is not about responsible forestry and sustainable wood or illegal logging, this is about a bureaucratic law," argues Juszkiewicz, who testified last year before a congressional hearing convened by Sen. It is alleged that the materials that were being used to make the guitars was breaking international laws. The controversial material that was confiscated was wood shipped from India. A Rare 'Triple-Humbucker' Explorer. This 'Second Version' Explorer is one of just 3656 guitars made between 1976 and 1979 and weighs 9.40 lbs. Solid mahogany body and one-piece mahogany neck with anut width of 1 11/16 inches, a scale length of 24 3/4 inches and wonderful medium-to-thick profile. Black faced headstock with pearl inlaid "Gibson" logo. Gold-plated, bell-shaped truss rod cover secured by two screws. Individual 'two-line' Gibson [Kluson Deluxe] tuners with oval metal buttons. Serial number "71598230" stamped in blind on back of headstock. Rosewood fretboard with 22 original jumbo frets and pearloid dot markers. Two Gibson Series Vll humbucking pickups in the neck and bridge position with outputs of 5.15k and 7.40k respectively. One Gibson Patent No. Humbucker (stamped on the underside "2737842") in the middle position with an output of 4.42k. The middle position pickup is activated by a push-pull switching sysyem on the second volume control. Single-layer black plastic pickguard with eight screws. The Feds are keeping mum, but in a statement yesterday Gibson's chairman and CEO, Henry Juszkiewicz, defended his company's manufacturing policies, accusing the Justice Department of bullying the company. "The wood the government seized Wednesday is from a Forest Stewardship Council certified supplier," he said, suggesting the Feds are using the aggressive enforcement of overly broad laws to make the company cry uncle. It isn't the first time that agents of the Fish and Wildlife Service have come knocking at the storied maker of such iconic instruments as the Les Paul electric guitar, the J-160E acoustic-electric John Lennon played, and essential jazz-boxes such as Charlie Christian's ES-150. In 2009 the Feds seized several guitars and pallets of wood from a Gibson factory, and both sides have been wrangling over the goods in a case with the delightful name "United States of America v. Ebony Wood in Various Forms."
