Too Much Copyright
"This disconnect between the public's view of copyright and fair use and what should and should not be prosecuted, versus the 'copyright maximist' view of the law, is our generation's Prohibition," says Ben Huh, CEO and founder of Cheezburger and a loud voice in the recent backlash to SOPA and PIPA, two congressional bills aimed at curbing internet piracy. Copyright exists to "promote the useful arts" according to the Constitution. But is it still doing that? And should the government protect so-called "intellectual property" in the same way it protects other forms of property? Reason.tv posed these questions to Ben Huh, as well as a professor and a movie studio representative. Tom Bell, a law professor specializing in property law, has serious reservations about attempts by groups like the Motion Picture Association of America (MPAA) to equate property and copyright through ad campaigns admonishing viewers with messages like, "You wouldn't steal a car. Downloading pirated movies is stealing." "As soon as we start using [the word] 'copyright' for 'property,' we start taking less seriously our property rights for things like cars and houses," says Bell. "When you steal a candy bar or a car, you've left somebody without something to eat or something to drive." But the MPAA's head content protection counsel, Ben Sheffner, thinks that piracy is a major problem that needs to be stopped. "If this kind of piracy is allowed to run rampant, it'll deprive the public of the next ...

How Copyright Threatens Democracy
Join Cory Doctorow, co-founder of the UK Open Rights Group, in discussing his dystopian vision of the growing conflict between free speech and the democratic principles of the Internet and the business aims of commercial media giants. Co-hosted by the New America Foundation's Open Technology Initiative, Public Knowledge and Copynight DC, Doctorow combines his perspective as an author, activist, co-editor of Boing Boing to outline the threats to a free and open Internet, speech, creativity and fair use, and innovation from boundless copyright protections. Looking forward, Doctorow's prediction is bleak: This means war. It is time to stop treating the industry's fight over copyright as a brush-war over creativity. The commercial media giants' business models and ambitions are increasingly incompatible with a free and open Internet, and hence a free and open society. Cory Doctorow is a science fiction author, activist, journalist and blogger -- the co-editor of Boing Boing and the author of the bestselling Tor Teens/HarperCollins UK novel Little Brother. He is the former European director of the Electronic Frontier Foundation and co-founded the UK Open Rights Group. Born in Toronto, Canada, he now lives in London. www.newamerica.net

YouTube Copyright Tutorial - Dispute Content ID Matches WMG
Tired of having your videos blocked by copyright claims by Warner Music Group (WMG)? This video describes how to dispute the copyright claim and have videos restored that are blocked by YouTube's automated Content ID system. It also provides a basic introduction to the principles of "fair use" and describes how to tell if your video qualifies for this exception to copyright law, even if you do use some copyrighted material in your video. To learn more, please visit fairusetube.org After being frequently asked how I managed to keep my videos from being blocked by copyright claims by Warner Music Group, I decided to start a website devoted to describing how to deal with copyright problems on YouTube and similar user generated video sites - http This video marks the official launch of that site, which provides a detailed Guide to YouTube Copyright Removals, instructions for disputing copyright claims on YouTube and other user generated video sites, and links to valuable resources for learning about copyright and fair use law online. NOTE: This video only describes the process for disputing videos block by YouTube's automated Content ID system. For videos that are blocked by DMCA takedown notices, you have to file a DMCA counter-notification to get the video restored. Fair Use School: Response to YouTube's Copyright School Video
This is my winning entry for Public Knowledge's video contest to create a response to YouTube's new "copyright school" video. While YouTube's video is generally informative about copyright law and user generated video, it falls short when it comes to its description of fair use, an exception to copyright protection that allows you to incorporate copyrighted content into your videos without the permission of the copyright holder. This video describes fair use in an easy-to-understand way, and shows that rather than being a bunch of complicated legalize that ordinary YouTube users could never understand, fair use is a simple principle that you can use as a weapon to fight abusive takedown notices and get your videos restored when they are blocked for copyright infringement. Note that this video is NOT legal advice, and fair use law is still very nebulous and uncertain--hence my frequent use of the word "probably." While the chances of being sued for filing a counter-notice are low, it should not be done lightly, and you assume any risk that results from taking such action. For more information on copyright, fair use, and YouTube, please visit my website, fairusetube.org, which features a detailed tutorial on how to dispute copyright blocks both under YouTube's automated Content ID system and with a DMCA counter-notice. Also visit Public Knowledge's website, at http Another great resource about fair use and YouTube videos is the Center for Social Media's "Code of Best ...

The Surprising History of Copyright and What It Means For...
Google Tech Talks August 15, 2006 Karl Fogel ABSTRACT Copyright is derived from a 16th-century English censorship law, later turned into a monopoly right to subsidize distribution. This history is somewhat at odds with the modern conception of copyright, and an understanding of it is increasingly important today, as the economics of distribution are changing radically. This talk will give the audience a mid-level overview of copyright's history, with pointers to further reading, followed by a survey of alternative economic bases for creation and distribution, and a discussion of what these dynamics mean for companies, like Google, that flourish in an environment of frictionless information...

COD Black Ops - Bill S.978 + Copyright Explained
I've gotten so many messages about this bill in the last few days. Click the time stamps below to skip ahead to a topic of interest. Many people don't realize that it's already illegal to post copyrighted content online (movies, tv shows, music, and video game footage). If you look on the back of any video game you own you will see a phrase saying something like "Unauthorized copying, reverse engineering, transmission, public performance, rental, pay for play, or circumvention of copy protection is strictly prohibited." People have already been striked on YouTube for posting gaming footage even with commentaries before this bill was ever proposed. The perfect example would have to be last year when Red Dead Redemption came out. Rockstar Games flagged many videos that were uploaded of that game without their permission. This is also why big YouTubers like Freddiew can't use video game footage in their videos. In fact, I remember Freddiew talking about how it took him a long time to get a YouTube partnership because of a guitar hero video he had when he 1st started. YouTube was worried that his video might get a strike and it delayed his partnership offering. He would need to get a separate YouTube gaming kind of partnership if he wanted to use gaming footage in videos. I don't think we need to panic because most game developers do not flag videos on YouTube. If the bill passed, repeat offenders (10 times), meaning people that continue to post videos infringing on the ...

Why Copyright? Canadian Voices on Copyright Law (Annotated Edition)
In June 2008, the Canadian government introduced Bill C-61, new copyright legislation that closely followed the US Digital Millennium Copyright Act. The public response to the bill was both immediate and angry - tens of thousands of Canadians wrote to the Minister and their local Members of Parliament, leading to town hall meetings, negative press coverage, and the growing realization that copyright was fast becoming a mainstream political and policy issue. This film, produced by Michael Geist and Daniel Albahary, asks Canadians from across the country and from a wide range of sectors the question - "why copyright?"
