The 4th Amendment just might be dead. It's an amendment designed to secure our privacy, and to protect the people from law enforcement over-stepping their bounds. To name a few, there's the ruling that declared Police can now force entry into a home, without a warrant, if they smell marijuana and if they hear sounds of "destroying evidence." Then there are those GPS tracking devices that were placed on cars by feds, without first obtaining a warrant.

Border Patrol (Uvalde, TX) Violation of Fourth Amendment - 18 March 2010

This video shows a fourth amendment violation, harassment, and intimidation by the Border Patrol in Uvalde, Texas. The driver is a military field grade officer, decorated for heroism, with more than two years of combat deployment time. He is driving from one American city to another and has crossed no borders. In the video the BP detains him quickly and without cause later claiming he refused to answer questions concerning his citizenship. The video shows this is clearly not the case. This charge is repeated by the supervisor who then contacts his military superiors in an (unfortunately successful) attempt to leverage his military service against him. He was detained for more than thirty minutes without cause. He was eventually told by the officers that they appreciated his cooperation and was released. The full footage was captured on five different cameras. The footage here is limited in length by upload requirements. A lawsuit has now been filed and is ongoing concerning this incident and several previous at the same checkpoint. Fortunately the driver was not assaulted for his oath-required support and defense of the US Constitution. Fourth Amendment Has been Suspended

The federal government is launching an expansive program dubbed "Perfect Citizen" to detect cyber assaults on private companies and government agencies running such critical infrastructure as the electricity grid and nuclear-power plants, according to people familiar with the program.The surveillance by the National Security Agency, the government's chief eavesdropping agency, would rely on a set of sensors deployed in computer networks for critical infrastructure that would be triggered by unusual activity suggesting an impending cyber attack, though it wouldn't persistently monitor the whole system, these people said. Defense contractor Raytheon Corp. recently won a classified contract for the initial phase of the surveillance effort valued at up to $100 million, said a person familiar with the project. An NSA spokeswoman said the agency had no information to provide on the program. A Raytheon spokesman declined to comment. Some industry and government officials familiar with the program see Perfect Citizen as an intrusion by the NSA into domestic affairs, while others say it is an important program to combat an emerging security threat that only the NSA is equipped to provide. "The overall purpose of the [program] is our Government...feel[s] that they need to insure the Public Sector is doing all they can to secure Infrastructure critical to our National Security," said one internal Raytheon email, the text of which was seen by The Wall Street Journal. Lakeville police stopped in front of his residence when they noticed the garage door was open. The officers rang the doorbell and knocked on the front door but when this didn't work they felt that this was just cause to enter his garage and investigate further. According to the Pioneer Press, the officers told Molde his garage door was open, the TV was on, keys to his truck were left in the ignition and the door to his house was ajar. Police said the intrusion was justified because the officers' initial door knocks went unanswered. Police went inside to check if anything was wrong, Sgt. Jim Puncochar said. The day after the incident Troy spoke about his ordeal on the Chris Baker radio show. He talks about what he did prior to the incident "...my car was in my garage with my keys in the ignition but I've always done that so I don't lose my key. Normally I shut my garage but I just happened to forget to shut it that night." He also disputes the some of the claims made by police and media "...the article says that the door was ajar, it wasn't, it has a spring on it so it wouldn't stay ajar and so the door was closed." Agents are recruiting truck drivers, like Rudy Gonzales, into the First Observer Highway Security Program to say something if they see something. "Not only truck drivers, but cars, everybody should be aware of what's going on, on the road," said Gonzales. It's all meant to urge every driver to call authorities if they see something suspicious. "Somebody sees something somewhere and we want them to be responsible citizens, report that and let us work it through our processes to abet the concern that they had when they saw something suspicious," said Paul Armes, TSA Federal Security Director for Nashville International Airport. The Tennessee Highway Patrol checked trucks with drug and bomb sniffing dogs during random inspections. A K-9 unit from Corinth Texas was called in and it alerted (false alert given by the handler, Officer Carson Crow). The vehicle was then unlawfully searched, nothing was found Man arrested for false charge of Resisting Arrest. I have no information as to the status of the tin badge nor of the arrested person.
